Terms of Service (End-User License Agreement) — PestSynch

1. The Service

PestSynch is a subscription-based business management platform for pest control companies, providing scheduling, customer management, invoicing, service documentation, and integrations with third-party services including QuickBooks and Stripe.

2. Your Account

  • You must be at least 18 years old and authorized to act on behalf of your business.
  • You are responsible for maintaining the confidentiality of your login credentials.
  • You are responsible for all activity under your account, including actions by users you invite (technicians, office staff).

3. Subscription and Payment

  • Subscription is $65 per month for the first user and $45 per month for each additional user. One plan — every feature included. Annual billing: $650 first user, $450 each additional (2 months free).
  • 14-day free trial; no credit card required to start a trial (unless stated at signup).
  • Subscriptions auto-renew until cancelled. Cancel anytime from your account settings; cancellation takes effect at the end of the current billing period. No prorated refunds.
  • Prices may change with 30 days' notice.

4. Your Data

  • You own your business data. Customer records, invoices, service history, and all other data you enter into PestSynch remains yours.
  • You grant us a limited license to host, process, and display your data solely to provide the service.
  • You may export your data at any time. Upon cancellation, you have 90 days to export before we delete it.
  • You are responsible for the accuracy of data you enter, including pesticide application records, which may be legal documents in your jurisdiction.

5. Third-Party Integrations

  • QuickBooks, Stripe, and other integrations are provided as a convenience and depend on those providers' availability and terms.
  • Connecting QuickBooks authorizes PestSynch to read and write the accounting data you permit via Intuit's OAuth flow.
  • We are not responsible for the operation, downtime, or data practices of third-party services.

6. Acceptable Use

You agree not to:

  • Use PestSynch for any unlawful purpose
  • Attempt to access other companies' data or circumvent access controls
  • Reverse-engineer, copy, or resell the service
  • Upload malicious code or content
  • Misrepresent pesticide application records or other regulated documentation

7. Service Availability

We strive for reliable service but do not guarantee uninterrupted availability. We may perform maintenance with reasonable notice. We are not liable for losses caused by service interruptions.

8. Limitation of Liability

To the maximum extent permitted by law:

  • PestSynch is provided "as is" without warranties of any kind.
  • Our total liability for any claim is limited to the amount you paid in the 12 months preceding the claim.
  • We are not liable for indirect, incidental, or consequential damages, including lost profits or lost business data (we recommend you maintain your own backups of critical records).

9. Indemnification

You agree to indemnify Conner Pest Services, LLC against claims arising from your use of the service, your business data, or your violation of these terms.

10. Termination

  • Either party may terminate with written notice.
  • We may suspend or terminate accounts for violation of these terms, non-payment, or unlawful activity.
  • Sections 4 (data export rights), 8, 9, and 11 survive termination.

11. Governing Law

These terms are governed by the laws of the State of Texas. Disputes will be resolved in the state or federal courts located in Collin County, Texas.

12. Changes

We may update these terms with 30 days' notice by email or in-app notification. Continued use after the effective date constitutes acceptance.
